Welcome to Fit Anywhere. These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", "your") and Artevus Technologies (Private) Limited ("Artevus", "Company", "we", "us", "our").

These Terms apply to your use of the Fit Anywhere mobile application on iOS and Android, related websites, and associated services (collectively, the "Service" or "App").

By accessing or using Fit Anywhere, you confirm that:

You have read, understood, and agree to these Terms and our Privacy Policy
You are at least 13 years of age (or 16 in the EU/EEA where required)
If you use the Service on behalf of an organization, you have authority to bind that organization

If you do not agree to these Terms, do not use the Service.

2. The Service

Fit Anywhere is a fitness application that allows users to access workout plans, record workouts, set goals, receive notifications, and track progress.

Fit Anywhere is a fitness and wellness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

3. Accounts

3.1 Registration

Certain features require an account. When creating an account, you agree to:

Keep your account information up to date
Maintain the confidentiality of your login credentials
Accept responsibility for activity that occurs under your account

3.2 Guest Use

You may use certain features without creating an account. Guest data is stored primarily on your device. Uninstalling the App or clearing app data may result in loss of guest data.

3.3 Account Deletion

You may delete your account at any time through the App. Account deletion is subject to a grace period during which you may cancel the request.

Fit Anywhere provides fitness tracking and informational metrics only.
The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Metrics such as calories, BMI, and similar estimates may be inaccurate.
Consult a qualified healthcare professional before beginning or changing an exercise program, especially if you have health concerns.
Exercise safely and do not exercise beyond your physical limits.

You use Fit Anywhere and any fitness information it provides at your own risk.

5. Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Fit Anywhere for personal fitness tracking purposes.

You agree not to:

Copy, modify, reverse engineer, or create derivative works of the Service
Use the Service for any unlawful purpose
Introduce malware or attempt to disrupt the Service
Attempt unauthorized access to accounts, systems, or networks
Resell or commercially exploit the Service without our prior written consent

6. User Content

You may submit content through the Service, including profile information, feedback, support requests, and photos ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant Artevus a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely as needed to operate and provide the Service.

You are responsible for your User Content and agree not to submit content that is unlawful or infringes the rights of others.

7. Intellectual Property

The App, including its software, design, branding, and related materials, is owned by Artevus or its licensors and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

Any feedback or suggestions you provide about the Service may be used by Artevus without restriction or compensation to you.

8. Availability and Notifications

We aim to keep the Service available, but we do not guarantee uninterrupted access or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time.

If you enable notifications, we may send workout reminders, re-engagement messages, and service-related notices. You may manage or disable notifications in the App and in your device settings.

9. Third-Party Services

The Service may integrate with or link to third-party services, including authentication providers and analytics. Your use of those services is subject to their own terms and privacy policies. Artevus is not responsible for third-party services.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTEVUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA, PERSONAL INJURY, OR SERVICE INTERRUPTION.

ARTEVUS’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ARTEVUS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

11. App Store Terms

If you downloaded Fit Anywhere from the Apple App Store or Google Play Store:

These Terms are between you and Artevus, not Apple or Google
Apple and Google are not responsible for the App or its content
Apple and Google are third-party beneficiaries of these Terms and may enforce them against you

12. Governing Law and Disputes

These Terms shall be governed by applicable law, without regard to conflict-of-law principles. If a dispute arises, you agree to first contact us at info@artevus.com to attempt informal resolution. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration to the extent permitted by applicable law.
